Overview of VUVOX's Privacy Guidelines
VUVOX is an online service that allows our members to set up and share personal expression channels. VUVOX members can view and share channels, meet new friends and collaborate to create new channels on the service. To enrich our members' experience, we request and display some personal information to other members and visitors. This allows our customer’s to identify each other and expand their network of sharing and friends. VUVOX members can change their profile information at any time and can control how other members and the service communicates with them.
Your Acceptance
This Privacy Policy applies to VUVOX Network, Inc. (“VUVOX” or “Site”) and/or other affiliated entities controlled by, or under common control with and through VUVOX Network, Inc. VUVOX respects the privacy of its users, and this Privacy Policy explains what information we collect on our Website and how we use such information. Please read this Privacy Policy carefully. In addition, please review the Terms of Use posted on VUVOX, which governs your use of the Website. Your use of our Website indicates to us that you have read and accepted our privacy practices, as outlined in this Privacy Policy and our Terms of Use. By using the Site, you consent to the information collection practices described herein.
What information does this Policy cover?
This Privacy Policy only covers personally identifiable information collected at this Website or when using VUVOX Services, and does not cover any information collected by any other Website (unless otherwise specifically stated or disclosed by VUVOX), its corporate affiliates, licensees or any other company.
This Policy uses the terms "personally identifiable information" and "personal information" (“PI”) synonymously. When we use either, we mean information that specifically identifies a particular individual, such as the individual's name, telephone number, email address or postal address, and any demographic or other information about a user, such as gender, birth date or a user's number of children, when such information is directly associated with personally identifiable information. Personal information does not include "aggregate" information, which is data we collect about a group or category of products, services or customers, from which individual customer identities have been removed. In other words, information about how you use a service may be collected and combined with information about how others use the same service, but no personal information will be included in the resulting data. Likewise, information about the products you purchase may be collected and combined with information about the products purchased by others. Aggregate data helps us understand trends and customer needs so that we can better consider new products and services, and tailor existing products and services to customer desires.
Information You Provide to Us
Generally, you may browse our Website without providing VUVOX with PI. However, there may be times when we asks you to provide us with certain PI, such as when you choose to register with our Website. We may also ask you to provide us with demographic information or information regarding your interests, hobbies or similar information to enhance your viewing and usage experience. VUVOX reserves the right, at any time, to add features to our Website that require you to register or otherwise provide additional PI or to require registration to access our Website. You can choose not to provide certain information, but then you may not be able to take advantage of or participate in some of the Website’s features. VUVOX does not sell, rent or share PI collected with other people other than that specifically outlined herein.
Anonymous Information: When you visit the Website, our web servers automatically collect Website usage information. Website usage information is anonymous information that describes how our visitors use and navigate our Website, and it includes the number and frequency of visitors to each web page, video and the length of their stays. We collect the anonymous information automatically sent to us by your web browser, such as browser type, referrer data that identifies the web page visited prior and subsequent to visiting our Website, and IP address. We may also determine what technology is available through your browser in order to serve you the most appropriate version of a web page (i.e. Flash or HTML).
Personal Information: VUVOX collects user submitted information such as name, email address, and age to authenticate users and to send notifications to those users relating to the VUVOX service. VUVOX also collects other profile data such as (but not limited to) personal interests, gender, age, education and occupation in order to assist users in finding and communicating with each other.
Much of the personally identifiable information we receive comes directly from users who register with the Site or who otherwise voluntarily provide information to us in connection with various activities on the Site. The information we request at registration includes, without limitation, name, age, postal address, e-mail address and telephone number. We may also collect other types of information during registration or in connection with your purchases or other activities on the Site, such as (but not limited to) credit card information, demographic information and information about or contained in postings you make in forums or any other interactive or user-created areas of the Site, your answers to surveys, your participation in sweepstakes, contests, games and promotional offers; and in any email request you send us for any reason (such as to request customer service or provide us with comments or feedback). Additionally, please note that any information you post in online bulletin boards, chat rooms or other public forums may be displayed publicly.
Any personal information you provide in our community or social spaces such as any comments in one of our chat rooms or any photographs or other personal information in one of our community profiles may be accessed by other participants and will in no way be kept private or confidential. In addition, we cannot control the use by others of such information.
Information Collected Through Technology
When visitors request pages from our Website, our servers log the visitor’s IP address. We may collect IP addresses for a variety of internal purposes, such as system administration, to report aggregate information to our business partners or to audit the number of visits to different pages or videos watched on our Website.
VUVOX may use cookies on the Site to collect certain information. A cookie is a small file a Web site sends to your computer while you are viewing the Web site. We and other companies use cookies for a variety of purposes such as to count the number of computers visiting the Site, to track transactional information on purchases you have made, to track a users path on the Site, to record registration information regarding your login name and password, to ensure you do not repeatedly see advertisements, and to record your user preferences. You can choose to have your computer warn you each time a cookie is being sent, or to turn off all cookies, by following the instructions in the Help pages of your Web browser. If you turn cookies off, you may not have access to many features that make your Web experience smoother, like the features mentioned above, and some of our services will not function properly. We do not link information we collect through cookies or other technology to your personal information. Rather, we only use it to compile aggregate information.
Ads appearing within the VUVOX Network may be delivered to our customers by VUVOX or one of our Network advertising partners. Our Network advertising partners may set cookies, web beacons, or other technology to collect non-personally identifiable information when you click on or move your cursor over one of their advertisements. These cookies allow the ad server to recognize your computer each time they send you an online advertisement. In this way, ad servers may compile information about where you, or others who are using your computer, saw their advertisements and determine which ads are clicked on. This information allows an ad network to deliver targeted advertisements that they believe will be of most interest to you. This privacy statement covers the use of cookies by VUVOX and does not cover the use of cookies by any advertisers. In some cases, we may have access to information from technology used by network advertisers on our sites and this information may permit us to identify other sites that you have visited that are also associated with the network advertiser.
Once you have clicked on an advertisement or any other link to a Web site other than the Site, you will have left the Site and our Policy no longer applies. In that situation, you must read the Policy of the Web site to which you have linked in order to see how your personal information will be handled on that Web site.
Information We Collect from Others
VUVOX also logs non-personally-identifiable information including IP address, profile information, aggregate user data, and browser type, from users and visitors to the site This data is used to manage the website, track usage and improve the website services. This non-personally-identifiable information may be shared with third-parties to provide more relevant services and advertisements to members. User IP addresses are recorded for security and monitoring purposes.
We may supplement personally identifiable information that we have collected directly from our customer’s with other information that we obtain from third parties. In addition, we may obtain information about individuals who are not yet users of the Site or VUVOX customers. When we associate information that we obtain from third parties with personally identifiable information that we have collected under this Policy, we will treat the acquired information like the information that we collected ourselves and, except as permitted by this Policy, the information will not be shared with third parties.
Uses and Disclosures of Your Personal Information
Personally identifiable information collected under this Policy is used by VUVOX for a number of purposes. For example, we may use your information to complete transactions requested by you (such as your purchase of a product or service offered on the Site), to provide you with customer service, to customize our products and services and the Site, to develop products or services, to respond to any questions, problems or complaints, to request feedback, to send you administrative communications about your account or about your use of the Site or any Site features or activities (such as contests and surveys) and for other purposes for which the information was provided and any purpose relating thereto. We refer to all of these types of uses of your personal information that do not involve the sending of promotional materials as "Operational Uses."
In addition, VUVOX may use your personal information to send you promotional materials about goods and services (including special offers and promotions) offered by VUVOX or third parties and for other marketing and promotional purposes. By "promotional materials," we mean communications for which the primary purpose is to directly promote the use of the Site, or the purchase of products or services from VUVOX or third parties. These promotional materials may be sent to you by postal mail, email or other means. From time to time, Customers may be asked to provide personal information including name, email address or home address or to answer questions in order to participate in a promotion or sponsorship opportunity. We may transfer personal information to certain ad partners that you have explicitly requested to receive information from. It will be clear at the point of collection who is collecting the personal information and whose privacy statement will apply.
You may opt out of receiving these promotional communications as provided in our registration process.
VUVOX may also use a customer’s email address to send updates, a newsletter or news regarding the service. Users may choose not to receive email of this type by changing their "notification" setting to "Do not send me notification emails" in the user "Account Settings".
User Profile information including members' pictures and first names are displayed to people in order to facilitate user interaction in the VUVOX community. Email addresses are used for the purposes of inviting new friends to join VUVOX, to add users to members' friends' networks, and to send notifications related to the service. With the exception of inviting friends, adding friends, and notifications, a user's email address is not shared or displayed to people within a user's personal network. Users' full names are never directly revealed to other members. To facilitate searching and finding friends and acquaintances on the service, VUVOX allows users to search for other members using first and last name, email address, and schools and/or companies where users may have attended or worked. Results will vary based on the customer’s having initiated a public or private profile.
Disclosures to Third Parties
Except in the limited circumstances described in this Policy, VUVOX will not sell, rent or share your personal information with third parties without your prior consent. VUVOX may, however, disclose your information to third-party vendors and consultants who assist us in performing internal functions in connection with the operation of our business. For instance, we may hire companies to help deliver products or services to you, process credit card payments, analyze data, provide marketing assistance, or send email communications to you, and we may disclose your personal information to these companies for those purposes. We are not responsible for any additional information you provide directly to these parties, and we encourage you to become familiar with their practices before disclosing any information directly to them.
Mergers and Business Transfers
Information about you, including your personal information, may be transferred as a part of any merger, acquisition, debt financing or sale of company assets, as well as in the event of an insolvency, bankruptcy or receivership in which personally identifiable information could be transferred to third parties as one of the business assets of VUVOX.
Consent to Transfer
The Website is operated in the United States. If you are located in the European Union or elsewhere outside of the United States, please be aware that any information you provide to us will be transferred to the United States. By using our Website, participating in any of our services and/or providing us with your information, you consent to this transfer.
Disclosures Required By Law and Disclosures to Help Protect the Security and Safety of the Site, VUVOX and Others
VUVOX may disclose personal information (a) when it believes in good faith that such disclosures are required by law, including, for example, to comply with a court order or subpoena, search warrant or other legal process; (b) to initiate, render, bill and collect for amounts owed to us; (c) to protect our rights, property or safety, or those of our customers or our users; (d) to protect our users from fraudulent, abusive or unlawful use of the Site; (e) to enforce contest, sweepstakes, promotions, game rules or the terms of any other agreement VUVOX may have with you; or (f) if we reasonably believe that an emergency involving immediate danger of death or serious physical injury to any person requires disclosure of communications or justifies disclosure of records without delay.
Correcting/Updating or Removing Information
VUVOX users may modify or remove any of their personal information at any time by logging into their account and accessing features such as Edit Profile and Account Info.
You have the opportunity to change, correct, or delete personal information that you have provided under this Policy, and to "opt out" of any use of your personally identifiable information that is not related to the primary purpose for which the information was collected.
You can exercise these choices during the registration process on the Site or after registration, by logging in to the Site, navigating to the User Account page, and following the directions provided. We may also provide you an opportunity to update your contact information and/or modify your opt-out choices by sending you an e-mail or other communication that invites your response. Additionally, you may unsubscribe from certain email communications by clicking the "unsubscribe" links or following other opt-out instructions in those emails. All Operational Uses shall be deemed relating to the primary purpose for which the information was collected. Therefore, any opt-out choices you make will not apply to Operational Uses or in situations where you have made, simultaneously make or later make a specific request for information from VUVOX, including, without limitation, ordering a product or service from VUVOX.
Finally, if you do not exercise your opt-out choices upon registration at the Site, it may take up to ten (10) days for your opt-out choices to be fully effective. Our systems require time to update. Thus, you might continue to receive promotional materials from VUVOX based upon the personal information you have provided under this Policy for up to ten (10) days after you elect to opt out.
What kinds of security measures do we take to safeguard your personally identifiable information?
The security and confidentiality of your information is important to us. VUVOX takes steps to secure the data you submit to us, including limiting the number of people who have physical access to our user data. Unfortunately, no data transmission over the Internet can be guaranteed to be 100% secure. Therefore, VUVOX cannot ensure or warrant the security of any information you transmit to VUVOX and you do so at your own risk.
We use appropriate, commercially reasonable means to protect your information from unauthorized access and improper use. Orders placed on the Site are protected by an encryption technology called Secure Sockets Layer (SSL), to ensure privacy and security when submitting an order. Please be aware, however, that despite our efforts, no security measures are perfect or impenetrable.
Additionally, your account information is accessible online only through the use of a password. To protect the confidentiality of your personal information, you must keep your password confidential and not disclose it to any other person. We suggest that you change your password periodically. You are responsible for all uses of the Site by any person using your password. Please advise us immediately if you believe your password has been misused.
How will you know if we amend this Policy?
We may amend this Policy at any time. We will post the amended Policy on the Site and indicate the date on which it was updated. If we make any material changes in the way we collect, use and/or share your personal information, we will notify you of such changes by (i) posting prominent notice on the Site for thirty (30) calendar days prior to the implementation of such material changes or, at our option, (ii) sending you email notification and posting prominent notice on the Site thereof, fourteen (14) calendar days prior to the implementation of such material changes. Your continued use of the Site after the effective date of changes to this Policy constitutes your agreement to the Policy as revised. We encourage you to review this Policy each time you visit our Site to see if it has been updated since your last visit and to make sure you understand how information you provide will be used.
